FRIENDSHARE® DETAILS, TERMS & CONDITIONS


This program is offered to persons subsequent to their purchase of a Timeshare Interest from Marriott Ownership Resorts, Inc., d/b/a Marriott Vacation Club International or one of its affiliates (“Company”) and is not made as an inducement in connection with the solicitation of a sale.

1. Definition of Terms

The following definitions of terms will help you understand how the FriendShare program works:

“Eligible State” is any state that permits Owners to be rewarded for their participation in the FriendShare program.

“Owner” is an individual who purchased and closed on a Timeshare Interest and who is in good standing with no delinquencies in payment of annual maintenance fees. If a Timeshare Interest is owned by more than one Owner, all Owners named on the deed will be considered one owner for purposes of these Terms and Conditions. Owners with multiple customer records in the Company’s central customer file should designate one customer record to submit all referrals and use when purchasing additional Timeshare Interests.

“Referral” or “Friend” is an individual (or a couple) who meets the qualifications for the offer and is preregistered with you as the referring Owner prior to the person(s) attending a sales presentation or purchasing a Timeshare Interest. To preregister you as the referring Owner, you or your Referral must provide your Referral’s name, an accurate means of contacting your Referral and your name as the referring Owner prior to your Referral attending a sales presentation or purchasing a Timeshare Interest.

“Timeshare Interest” is a deeded real estate interest, direct or indirect trust interest, or right-to-use interest in a timeshare plan sold by Company.

2. Eligibility

An Owner who provides a Referral to Company shall be eligible to receive a reward pursuant to the terms of these FriendShare Program Details, Terms and Conditions. Due to a variety of real estate regulations, the terms and conditions of the FriendShare program may vary by country and state. Your residence, as reflected in the Company’s central customer file, will determine your eligibility as well as the terms and conditions under which you may participate in the FriendShare program. The FriendShare program is void where prohibited by law.

Employees of Marriott Vacations Worldwide Corporation, and its affiliates and subsidiaries are ineligible to receive any award through the FriendShare program.

Other than Owners who reside in a “Tour State” (as defined below), an Owner will be eligible to receive an award through the FriendShare program only if that Owner’s Referral purchases (i) at least six (6) Beneficial Interests (the equivalent of 1,500 Club Points) in the MVC Trust, or (ii) a minimum of one or more vacation ownership interests in a Vistana Signature Experiences timeshare program with an associated value of 51,700 StarOptions or more.

FriendShare Start Date: The FriendShare program’s benefits, as described below, are effective as of August 1, 2022. If you reside in an Eligible State, you may receive the benefits detailed in these Details, Terms and Conditions when your Friend purchases a Timeshare Interest on or after August 1, 2022.

Duplication of Referrals: In the event of a duplication of a Referral, the Owner who most recently preregistered the Referral with Company will have precedence and will receive the reward.

Exclusions:  Referrals who purchase a Timeshare Interest from any individual or entity, other than Company or through a sale not brokered by Company shall not entitle an Owner to earn any award through the FriendShare program.

 

 

 

 

  1. Rewards

Eligible State: Residents of Alabama, Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Mississippi, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Dakota, Ohio, Oklahoma, Rhode Island, South Carolina, South Dakota, Tennessee, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin and Wyoming. Puerto Rico and the District of Columbia are eligible to participate in the FriendShare program (hereinafter collectively referred to as “Eligible State”). Restrictions may apply. Company reserves the right to add or remove an Eligible State, at any time, as business and legal circumstances allow.

Eligible State Rewards – Rewards are based on an Owner’s Benefit Level:

** A Preview Package is a discounted stay at a Company resort during which stay the Referral is required to attend a timeshare sales presentation.

Rewards for Owners who are not Members of the Abound by Marriott VacationsTM Exchange Program or the Vistana Signature NetworkTMOwners who are not Members of Abound or the Vistana Signature Network may receive a choice of (i) 50,000 Marriott Bonvoy points or (ii) a $500 maintenance fee credit for Referrals submitted under the FriendShare Program.

Rewards for Owner Purchases: Owners who purchase additional Timeshare Interests shall not be eligible for any reward under the FriendShare Program.

Canada:  Only Owners who reside in the Canadian provinces of Alberta and British Columbia are eligible to receive FriendShare benefits, and only for Referrals who reside in the US.

State Regulatory Restrictions:

Owners in Oregon and Kansas: Due to state regulations, residents of Oregon and Kansas are not eligible to participate in the FriendShare Program.

Owners in Minnesota, North Carolina, Pennsylvania and Texas (“Tour States”): Due to state regulations, residents of these states may receive FriendShare benefits after their Referral completes a sales presentation. FriendShare rewards for residents of Minnesota, North Carolina and Pennsylvania may not exceed 15,000 Marriott Bonvoy points or a $150 maintenance fee credit after a Referral completes a sales presentation. Residents of Texas are eligible to receive up to 5,000 Marriott Bonvoy points or up to a $50 maintenance fee credit per Referral, after the Referral completes a sales presentation.

Owners in Arizona, Hawaii and Ohio: Due to state regulations, Owners who reside in Arizona, Hawaii, or Ohio may only receive benefits from this FriendShare program or any other similar program offered by Company with a maximum value of $1,000 during a 12-month period.

Owners in Virginia: Due to state regulations, FriendShare benefits for Virginia residents may not exceed 15,000 Marriott Bonvoy points or up to a $150 maintenance fee credit if the Referral completes a sales presentation within the state of Virginia at a Company resort or via telephone. Virginia residents may receive Eligible State benefits if their Referral purchases at any Company property outside the state of Virginia.

Owners in Florida, Nevada, Puerto Rico and New Jersey: Due to state regulations, residents of Florida, Nevada and Puerto Rico may provide a maximum of 20 Referrals per calendar year. Residents of New Jersey may provide a maximum of 12 Referrals per calendar year.

  1. Rewards Redemption, Terms and Agreements

FriendShare Benefit: For Marriott Vacation Club Owners, Marriott Bonvoy points are the default FriendShare benefit. To change your FriendShare benefit from Marriott Bonvoy points to maintenance fee credit or PlusPoints:

If you are a Vistana Signature Experiences Owner you must select your benefit by contacting Owner Services at 800.239.2197.

*The benefit change/selection must be made prior to you or your Referral completing a sales presentation or purchasing Timeshare Interests.

Marriott Bonvoy: For complete Marriott Bonvoy Program Terms and Conditions, please refer to http://www.marriott.com/loyalty.mi. To redeem your Marriott Bonvoy points, please call 800-450-4442 or visit http://www.marriott.com/loyalty/redeem.mi for assistance. The Marriott Bonvoy program is void where prohibited by law.

Award of Marriott Bonvoy Points: Marriott Bonvoy points for Owners from Eligible States will be credited to your account within 4 to 6 weeks after the closing of the purchase of Timeshare Interests by your Referral.  Marriott Bonvoy points for Owners from Tour States will be credited to your account within 4 to 6 weeks after the completion of a sales presentation by your Referral. Only your Referrals’ initial tour or purchase, as applicable, at any Company resort will qualify you to receive Marriott Bonvoy points.

Redemption of Marriott Bonvoy points is subject to the terms and conditions of the Marriott Bonvoy Program. Marriott Bonvoy, Marriott International, Inc. and its partners have the right to change, limit, modify or cancel Marriott Bonvoy program rules, regulations, rewards and reward levels at any time. That includes, but is not limited to, increasing levels or number of Marriott Bonvoy points required for a reward, changing rewards, adding unlimited blackout dates, limiting rooms available at any Marriott hotel or resort, Marriott travel partners, or changing or canceling our travel partner rewards. In the event that any of these conditions occur, you may not be able to obtain certain rewards. Company has the right to change, limit, modify, terminate or cancel the FriendShare Program, Marriott Bonvoy Program or their rules, regulations, rewards and reward levels at any time.

In the case of fraud or abuse involving the FriendShare Program, Marriott Bonvoy points or Marriott Bonvoy point use, Marriott International, Inc. and its travel partners have the right to take appropriate administrative and/or legal action, and all accrued Marriott Bonvoy points or other FriendShare benefits will be forfeited and your account closed.

Maintenance Fee Credit: Maintenance fee credits for Owners from Eligible States will be credited to your account within 4 to 6 weeks after the closing of the purchase of Timeshare Interests by your Referral.  Maintenance fee credits for Owners from Tour States will be credited to your account within 4 to 6 weeks after the completion of a sales presentation by your Referral. Only your Referrals’ initial tour or purchase, as applicable, at any Company resort will qualify you to receive the maintenance fee credit.

In the event that you own more than one Timeshare Interest and your Referral purchases or tours (for Tour States), as applicable, the credit will be applied first to your maintenance fee obligation(s) at the resort where the Referral purchases or tours (for Tour States). In the event you do not own a Timeshare Interest at the resort where your Referral purchases or tours (for Tour States), the maintenance fee credit then will be applied to your highest unpaid maintenance fee obligation. The credit will be applied to your next due and outstanding maintenance fee obligation based on the date your Referral closes on their purchase or completes a tour (for Tour States).

In the event accumulated maintenance fee credits acquired during a calendar year reach 100% of your next due and outstanding maintenance fee obligation, the remaining balance of your maintenance fee credits will be applied to the following year’s maintenance fee obligation, or for Owners with multiple Timeshare Interest purchases the remaining balance of your maintenance fee credit will be applied to your next oldest unpaid maintenance fee obligation. Any IRS Form 1099 issued in such a situation will reflect maintenance fee credits applied to the current calendar year’s maintenance fee obligations.

Maintenance fee credits are nontransferable and cannot be redeemed for cash. In the event that you sell your Timeshare Interest(s) and are no longer responsible for any future maintenance fees, any unapplied maintenance fee credits accumulated will be forfeited immediately.

Maintenance fee credits cannot be applied to past-due or delinquent maintenance fee obligations.

The maintenance fee credit does not apply to real estate property taxes or any special assessments that may be levied by the local jurisdiction or your timeshare owners association, and/or billed separately.

Award of PlusPoints: PlusPoints are only available to Owners who are Members of AboundTM by Marriott Vacations (the “Exchange Program”) or the Vistana Signature Network at the time of the award.  PlusPoints will be deposited in the Owner’s account within 60 days after eligibility for the reward pursuant to the FriendShare Program.  Owner may use PlusPoints to reserve Accommodations and other Exchange Benefits within the Exchange Program, subject to terms and conditions of the Exchange Company Documents.  PlusPoints shall expire 24 months following their date of posting to an Owner’s account and such expiration date cannot be extended.  PlusPoints are nontransferable and may not be banked, borrowed, or traded for Marriott Bonvoy Points. Reservations made using awarded PlusPoints must be booked after the PlusPoints are posted to an Owner’s account and for a stay with arrival on or before the expiration date.​

General:  The awarding of Marriott Bonvoy points, maintenance fee credits or PlusPoints may subject you to tax liability and/or other charges that will be your sole responsibility.

All foreign, federal, state and local taxes on the credits received from the FriendShare Program or any other similar program offered by Company and any and all applicable fees imposed by entities other than Company will be the obligation of the Owner. Company will issue an IRS Form 1099 to you for any FriendShare benefit or combination of benefits valued at $600 or more in a given calendar year.  If Owner is a non-resident alien (as defined under the U.S. Internal Revenue Code), Company is required by law and current international tax treaties to withhold thirty percent (30%) of the maintenance fee credit; therefore, such amount shall be deducted from such Owner’s maintenance fee credit and handled as required by the Internal Revenue Service.

 

 

 

  1. Additional Regulations

Your use of marketing channels, including but not limited to print media or online advertising, to attract individuals for referral shall be considered an abuse of the FriendShare Program and may result in termination or forfeiture of any accrued FriendShare benefits or other penalties. Referrals obtained through submittal of membership lists, telephone directories or other similar sources will not be accepted. Company reserves the right to accept or reject referrals, and to change the details, terms and conditions of the FriendShare Program, at any time, in its sole discretion. Company also reserves the right to deny any Owner the ability to participate in the FriendShare Program.

The purpose of this program is to obtain the names and addresses of prospective purchasers. Any acquired names and addresses may be used for the purpose of soliciting sales of Timeshare Interests. By participating in this program, you acknowledge and consent that Company may from time to time disclose to your Referral that you provided your Referral’s contact information. This is not an offer to sell or a solicitation to purchase anything. You should not undertake any representation of any Company Timeshare Interest or vacation ownership program whatsoever. You are not authorized to present, sell or negotiate the sale of real estate. This program is not a contest.
